Our attorneys have significant experience in probate administration of both simple and complex estates. We assist clients with probating wills or in the administration of estates where the decedent died without a will ("intestate").
A comprehensive, well-drafted estate plan takes into consideration various contingencies, including the possibility of the future disability or incapacity of an individual. Certain estate planning documents such as statutory durable powers of attorney, durable medical powers of attorney, and directives to physicians are designed to provide a plan for the management of one's personal, medical and financial affairs in the event of future incapacity.
In the event a person becomes incapacitated, and does not have estate planning documents in place designating who will manage their financial affairs or make decisions regarding their care, our attorneys can assist in obtaining the appointment of a guardian and can advise the guardian regarding their fiduciary duties and obligations. In the event an incapacitated or deceased person has minor children, our attorneys can also assist in obtaining the appointment of a guardian for the children.
